If you are investigated for or accused of a crime, we strongly urge you not to speak to the police or prosecutor before meeting with an attorney to discuss your choices. If you have been arrested, you should tell the officer you wish to remain silent until you have spoken to an attorney. Although having to say something to invoke your right to stay silent might seem contradictory, failure to state your wish to remain silent could lead to your giving up that right. Using your right to remain silent does not mean that you may not later give a statement. It only means you do not want to answer questions without a lawyer present to advise you.
